Personal Information Collection and Privacy Policy Statement<\/h3>\n

\u500b\u4eba\u8cc7\u6599\u6536\u96c6\u53ca\u79c1\u96b1\u653f\u7b56\u8072\u660e<\/strong><\/h3>\n

Waterfall Sports & Wellness (the \u201cCompany\u201d) is committed to protecting the privacy, confidentiality and security of the personal information we hold by complying with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong) (\u201cOrdinance\u201d). The Company is equally committed to ensuring that all our employees, officers and agents uphold these obligations. This Personal Information Collection Statement (the \u201cStatement\u201d) is to notify you of the Company\u2019s collection, usage, storage, transfer and disclosure of your personal data.<\/p>\n

1. Collection of your Personal Data and Purpose<\/p>\n

(a) From time to time, it is necessary for us to collect your personal data (\u201cPersonal Data\u201d) as follows for processing your application to register as a member, providing you with services and\/or products, and carrying out other activities described in Paragraphs 1(b) and\/or 1(c) below.<\/p>\n

(b) The Company may collect your full name, gender, HKID\/passport number, date of birth, mobile number, email address and\/or residential address for one or more of the following purposes:
\nA. for the facilities and\/or services provided by the Company;
\nB. for communication, promotional, customer relationship management and\/or public relations;
\nC. for application, creation, operation and administration of accounts and records for customers, members or users;
\nD. to handle comments, enquiries and complaints;
\nE. to process or request billing and payment, determining amounts outstanding, and if necessary, collection of outstanding payments;
\nF. for identification and verification of your identity;
\nG. designing, reviewing, evaluating and enhancing our services, products, facilities or activities (including conducting research, survey and analysis for those purposes);
\nH. making disclosure when required by any law, regulation, court order, direction, code or guideline applicable in or outside Hong Kong; and\/or
\nI. for purposes directly relating to any of the above purposes.
\nYou are not obliged to provide your Personal Data; however, the Company may not be able to process your registration, provide services and\/or products to you, and\/or carry out such other activities.<\/p>\n

(c) It is necessary for the Company to collect your palm vein and image of your face (\u201cBiometric Data\u201d) for the purpose of identification and verification and venue management (e.g., self check-in, wristbands and towels borrowing and returning, classroom and gym room management), providing a contactless check-in and paperless experience. If you do not consent to provide such kind of information, your membership application\/membership may be rejected\/terminated, and the Company may not be able to provide the relevant services and\/or products to you.<\/p>\n

2. Use of your Personal Contact Information in Direct Marketing<\/p>\n

(a) The Company intends to use your full name, contact information and address (collectively the \u201cPersonal Contact Information\u201d) to send you direct marketing communications regarding products and\/or services of fitness, healthcare and lifestyle. The Company may not use your Personal Contact Information in such manner unless we have received your express consent or your indication of no objection before using your Personal Contact Information.<\/p>\n

(b) You have the right to choose whether your Personal Contact Information is used for direct marketing purposes. If at any time you consent to the use of your Personal Contact Information in direct marketing but subsequently changes your mind, you have the right to write to the Data Protection Officer via the email address provided below to inform the Company that you no longer wish the Company to use your Personal Contact Information in direct marketing.<\/p>\n

3. Disclosure or Transfer
\n(a) The Company will take all practicable steps to keep your Personal Data confidential. Your Personal Data collected by us will not be disclosed to any third party for direct marking or other irrelevant purposes without your prior consent, except for the situations as below:<\/p>\n

A. The Company may provide to any agent, contractor or third party who provides administrative, technology or other services to the Company and has a duty of confidentiality to the same, and provide to and any of our subsidiaries, holding companies, associated companies or affiliated companies,
\n(i) your Personal Data collected for the purpose(s) set out in Paragraph 1(b) in order to achieve such purpose(s); and\/or
\n(ii) your Personal Data collected for the purpose(s) set out in Paragraph 1(c) in order to achieve such purpose(s)\uff1b<\/p>\n

B. The Company may disclose your Personal Data to any governmental or law enforcement agency, judicial body or regulatory authority to whom we are required to make disclosure according to any law, regulation, court order, direction, code or guideline.<\/p>\n

(b) As the parties mentioned above may be located outside Hong Kong, your Personal Data may be transferred out of Hong Kong.<\/p>\n

4. Security
\n(a) The Company maintains appropriate security measures to protect your Personal Data against any accidental, unlawful or unauthorised destruction, loss, alteration, access, disclosure, or use.<\/p>\n

(b) Regarding the Biometric Data, such would be first converted into encrypted digital feature codes specific to our system for storage and subsequent use. Without the key, encrypted palm vein and face images could not be read, processed, recognized or used. The encrypted signature is stored in the company’s local server, and data verification is done through SSL communication.<\/p>\n

(c) All our employees, agents, Affiliates and services providers are bound by confidentiality. Only authorised persons may handle your Personal Data on a \u201cneed-to-know\u201d basis in accordance with the Ordinance and this Statement.<\/p>\n

5. General Matters
\n(a) You have the right to request to (i) access and correct your Personal Data held by the Company and (ii) opt-out from receiving direct marketing communications. To exercise your rights and avoid potential miscommunication or misunderstanding, please send a request in writing via email to our Data Protection Officer at info@waterfall.com.hk. The Company will comply with your request(s) as soon as reasonably practicable.<\/p>\n

(b) We will keep your Personal Data for so long as is necessary to fulfill the purpose for which the data was collected. If you terminate your membership, the Company will permanently erase your Personal Data as soon as practicable.<\/p>\n

(c) In case of any discrepancy between the English and Chinese versions, the English version shall prevail.<\/p>\n

Waterfall Sports & Wellness\uff08\u300c\u672c\u516c\u53f8\u300d\uff09\u81f4\u529b\u9075\u5b88\u300a\u500b\u4eba\u8cc7\u6599\uff08\u79c1\u96b1\uff09\u689d\u4f8b\u300b\uff08\u9999\u6e2f\u6cd5\u4f8b\u7b2c486\u7ae0\uff09\uff08\u300c\u8a72\u689d\u4f8b\u300d\uff09\u7684\u898f\u5b9a\uff0c\u4ee5\u4fdd\u969c\u672c\u516c\u53f8\u6240\u6301\u6709\u7684\u500b\u4eba\u8cc7\u6599\u7684\u79c1\u96b1\u6027\u3001\u4fdd\u5bc6\u6027\u53ca\u5b89\u5168\u6027\u3002\u672c\u516c\u53f8\u540c\u6a23\u81f4\u529b\u65bc\u78ba\u4fdd\u6211\u5011\u7684\u6240\u6709\u54e1\u5de5\u3001\u9ad8\u7d1a\u8077\u54e1\u548c\u4ee3\u7406\u4eba\u9075\u5b88\u9019\u4e9b\u7fa9\u52d9\u3002\u672c\u500b\u4eba\u8cc7\u6599\u6536\u96c6\u8072\u660e\uff08\u300c\u672c\u8072\u660e\u300d\uff09\u65e8\u5728\u901a\u77e5\u95a3\u4e0b\u6709\u95dc\u672c\u516c\u53f8\u6536\u96c6\u3001\u4f7f\u7528\u3001\u5132\u5b58\u3001\u8f49\u79fb\u53ca\u62ab\u9732\u95a3\u4e0b\u7684\u500b\u4eba\u8cc7\u6599\u76f8\u95dc\u5b89\u6392\u3002<\/p>\n

(b) \u672c\u516c\u53f8\u53ef\u80fd\u6703\u6536\u96c6\u95a3\u4e0b\u7684\u5168\u540d\u3001\u6027\u5225\u3001\u9999\u6e2f\u8eab\u4efd\u8b49\/\u8b77\u7167\u865f\u78bc\u3001\u51fa\u751f\u65e5\u671f\u3001\u6d41\u52d5\u96fb\u8a71\u865f\u78bc\u3001\u96fb\u90f5\u5730\u5740\u53ca\/\u6216\u4f4f\u5740\uff0c\u7528\u65bc\u4ee5\u4e0b\u4e00\u500b\u6216\u591a\u500b\u7528\u9014\uff1a

\n\u95a3\u4e0b\u53ef\u81ea\u9858\u9078\u64c7\u63d0\u4f9b\u500b\u4eba\u8cc7\u6599\uff1b\u7136\u800c\uff0c\u82e5\u95a3\u4e0b\u62d2\u7d55\u63d0\u4f9b\uff0c\u672c\u516c\u53f8\u53ef\u80fd\u7121\u6cd5\u8655\u7406\u60a8\u7684\u7533\u8acb\u3001\u5411\u60a8\u63d0\u4f9b\u670d\u52d9\u53ca\/\u6216\u7522\u54c1\uff0c\u53ca\/\u6216\u9032\u884c\u5176\u4ed6\u76f8\u95dc\u6d3b\u52d5\u3002<\/p>\n

(c) \u672c\u516c\u53f8\u9700\u8981\u6536\u96c6\u60a8\u7684\u638c\u975c\u8108\u53ca\u4eba\u81c9\u5f71\u50cf(\u300c\u751f\u7269\u7279\u5fb5\u6578\u64da\u300d)\uff0c\u4ee5\u7528\u65bc\u6703\u54e1\u8eab\u4efd\u8b58\u5225\u53ca\u9a57\u8b49\u53ca\u5834\u6240\u7ba1\u7406 (\u5982\u81ea\u52a9\u5165\u5834\u767b\u8a18\u3001\u624b\u74b0\u53ca\u6bdb\u5dfe\u501f\u7528\u53ca\u56de\u6536\u3001\u8ab2\u5ba4\u8207\u5065\u8eab\u5ba4\u4eba\u6d41\u7ba1\u63a7)\uff0c\u63d0\u4f9b\u7121\u63a5\u89f8\u7c3d\u5230\u53ca\u7121\u7d19\u5316\u9ad4\u9a57\u3002\u5982\u679c\u60a8\u4e0d\u540c\u610f\u63d0\u4f9b\u6b64\u985e\u8cc7\u6599\uff0c\u60a8\u7684\u6703\u54e1\u7533\u8acb\/\u8cc7\u683c\u53ef\u80fd\u6703\u88ab\u62d2\u7d55\/\u7d42\u6b62\uff0c\u4e14\u672c\u516c\u53f8\u53ef\u80fd\u7121\u6cd5\u5411\u60a8\u63d0\u4f9b\u76f8\u95dc\u670d\u52d9\u53ca\/\u6216\u7522\u54c1\u3002<\/p>\n

2. \u76f4\u92b7\u4e2d\u4f7f\u7528\u60a8\u7684\u500b\u4eba\u806f\u7d61\u8cc7\u8a0a
\n(a) \u672c\u516c\u53f8\u64ec\u4f7f\u7528\u60a8\u7684\u5168\u540d\u3001\u806f\u7d61\u8cc7\u8a0a\u548c\u5730\u5740\uff08\u300c\u500b\u4eba\u806f\u7d61\u8cc7\u8a0a\u300d\uff09\u5411\u60a8\u5bc4\u9001\u6709\u95dc\u5065\u8eab\u3001\u4fdd\u5065\u53ca\u751f\u6d3b\u65b9\u5f0f\u4e4b\u7522\u54c1\u548c\/\u6216\u670d\u52d9\u7684\u76f4\u92b7\u901a\u8a0a\u3002\u9664\u975e\u672c\u516c\u53f8\u5728\u4f7f\u7528\u60a8\u7684\u500b\u4eba\u806f\u7d61\u8cc7\u8a0a\u524d\u5df2\u7372\u5f97\u60a8\u7684\u660e\u78ba\u540c\u610f\u6216\u4e0d\u53cd\u5c0d\u901a\u77e5\uff0c\u5426\u5247\u672c\u516c\u53f8\u4e0d\u5f97\u5982\u6b64\u4f7f\u7528\u60a8\u7684\u500b\u4eba\u806f\u7d61\u8cc7\u8a0a\u3002<\/p>\n

(b) \u60a8\u6709\u6b0a\u9078\u64c7\u60a8\u7684\u500b\u4eba\u806f\u7d61\u8cc7\u8a0a\u662f\u5426\u7528\u65bc\u76f4\u63a5\u4fc3\u92b7\u76ee\u7684\u3002\u5982\u60a8\u5728\u4efb\u4f55\u6642\u9593\u540c\u610f\u60a8\u7684\u500b\u4eba\u806f\u7d61\u8cc7\u8a0a\u7528\u65bc\u76f4\u63a5\u4fc3\u92b7\u4f46\u5f8c\u4f86\u60a8\u6539\u8b8a\u4e3b\u610f\uff0c\u60a8\u53ef\u6309\u4e0b\u6587\u6240\u63d0\u4f9b\u7684\u96fb\u90f5\u5730\u5740\u81f4\u51fd\u8cc7\u6599\u4fdd\u969c\u4e3b\u4efb\uff0c\u901a\u77e5\u672c\u516c\u53f8\u60a8\u4e0d\u518d\u5e0c\u671b\u672c\u516c\u53f8\u5c07\u60a8\u7684\u500b\u4eba\u806f\u7d61\u8cc7\u8a0a\u7528\u65bc\u76f4\u63a5\u4fc3\u92b7\u3002<\/p>\n

\n(ii) \u63d0\u4f9b\u70ba\u7b2c1(c)\u6bb5\u6240\u8ff0\u76ee\u7684\u6240\u6536\u96c6\u4e4b\u60a8\u7684\u500b\u4eba\u8cc7\u6599\uff0c\u4ee5\u9054\u5230\u4e0a\u6587\u7b2c1(c)\u6bb5\u7684\u76ee\u7684\uff1b<\/p>\n

B. \u5728\u4efb\u4f55\u6cd5\u5f8b\u3001\u898f\u4f8b\u3001\u6cd5\u9662\u547d\u4ee4\u3001\u6307\u4ee4\u3001\u5b88\u5247\u6216\u6307\u5f15\u4e0b\uff0c\u672c\u516c\u53f8\u53ef\u80fd\u5411\u4efb\u4f55\u653f\u5e9c\u6216\u57f7\u6cd5\u6a5f\u69cb\u3001\u53f8\u6cd5\u6a5f\u95dc\u6216\u76e3\u7ba1\u6a5f\u69cb\u62ab\u9732\u500b\u4eba\u8cc7\u6599\u3002<\/p>\n

(b) \u7531\u65bc\u4e0a\u8ff0\u55ae\u4f4d\u53ef\u80fd\u8eab\u8655\u9999\u6e2f\u5883\u5916\uff0c\u60a8\u7684\u500b\u4eba\u8cc7\u6599\u4ea6\u53ef\u80fd\u88ab\u8f49\u79fb\u81f3\u9999\u6e2f\u4ee5\u5916\u5730\u5340\u3002<\/p>\n

4. \u5b89\u5168\u6027
\n(a) \u672c\u516c\u53f8\u63a1\u53d6\u9069\u7576\u7684\u5b89\u5168\u63aa\u65bd\uff0c\u4ee5\u4fdd\u8b77\u60a8\u7684\u500b\u4eba\u8cc7\u6599\u4e0d\u53d7\u610f\u5916\u3001\u975e\u6cd5\u6216\u672a\u7d93\u6388\u6b0a\u7684\u7834\u58de\u3001\u907a\u5931\u3001\u7be1\u6539\u3001\u5b58\u53d6\u3001\u62ab\u9732\u6216\u4f7f\u7528\u3002<\/p>\n

(b) \u5c31\u751f\u7269\u7279\u5fb5\u6578\u64da\u800c\u8a00\uff0c\u5176\u5c07\u6703\u5148\u88ab\u8f49\u63db\u70ba\u672c\u516c\u53f8\u7cfb\u7d71\u5c08\u7528\u4e4b\u52a0\u5bc6\u7279\u5fb5\u7de8\u78bc\uff0c\u4ee5\u4f5c\u5132\u5b58\u53ca\u4f7f\u7528\uff0c\u7d93\u904e\u52a0\u5bc6\u7684\u638c\u975c\u8108\u53ca\u4eba\u81c9\u5f71\u50cf\u5728\u672a\u7d93\u89e3\u5bc6\u7684\u60c5\u6cc1\u4e0b\uff0c\u4e0d\u80fd\u88ab\u8b80\u53d6\u3001\u8655\u7406\u3001\u8fa8\u8b58\u6216\u4f7f\u7528\u3002\u52a0\u5bc6\u7279\u5fb5\u7de8\u78bc\u5b58\u5132\u65bc\u672c\u516c\u53f8\u7684\u672c\u5730\u4f3a\u670d\u5668\uff0c\u8cc7\u6599\u9a57\u8b49\u901a\u904eSSL\u52a0\u5bc6\u901a\u4fe1\u3002<\/p>\n

(c) \u6211\u5011\u7684\u6240\u6709\u54e1\u5de5\u3001\u4ee3\u7406\u4eba\u3001\u95dc\u806f\u516c\u53f8\u548c\u670d\u52d9\u4f9b\u61c9\u5546\u5747\u53d7\u4fdd\u5bc6\u7d04\u675f\u3002\u53ea\u6709\u7372\u6388\u6b0a\u4eba\u58eb\u53ef\u6839\u64da\u8a72\u689d\u4f8b\u548c\u672c\u8072\u660e\uff0c\u5728\u300c\u6709\u9700\u8981\u77e5\u9053\u300d\u7684\u57fa\u790e\u4e0a\u8655\u7406\u60a8\u7684\u500b\u4eba\u8cc7\u6599\u3002<\/p>\n
